What are the limitations on the use of Lawclerks?

To use LAWCLERK to outsource work to our Lawclerks, Attorneys must agree to the following terms:

1. For each project where the Attorney has selected and assigned the project to a Lawclerk (an "Assigned Project"), the Attorney shall have sole responsibility for the work product provided by the Lawclerk to the Attorney.

2. For each Assigned Project, the Attorney shall supervise the Lawclerk’s performance of service on the Assigned Project to ensure compliance with the applicable Rules of Professional Conduct.

3. For each Assigned Project, the Attorney shall establish and maintain the relationship with the Attorney’s client(s).

4. For each Assigned Project, the Lawclerk shall have no contact with the Attorney’s client(s), including without limitation email, telephone, skype, web, social media, or inperson contact.

5. For each Assigned Project, the Lawclerk shall not appear in court or any other judicial or administrative body on behalf of the Attorney’s client(s).

6. For each Assigned Project, the Attorney shall not ask or otherwise cause the Lawclerk to serve or otherwise disseminate the Lawclerk’s work product or any other documents to anyone other than the Attorney.

7. For each Assigned Project, the Attorney shall not ask or otherwise cause the Lawclerk to sign or file any documents with any court or administrative body.

8. For each Assigned Project, the Lawclerk shall have no contact with opposing counsel, witnesses, or other persons potentially involved in the Project for which the Lawclerk has been engaged, including without limitation email, telephone, skype, web, social media, or in-person contact.

9. Attorneys shall comply with applicable law concerning the utilization of Lawclerks.

10. For each Assigned Project, the Attorney shall have the sole responsibility for determining the fee charged to his or her clients for legal services. The Lawclerk shall not have any involvement in determining the fee the Attorney charges his or her client(s).

11. All payment for services provided by Lawclerks shall be completed through www.lawclerk.legal.

12. Attorneys and Lawclerks shall immediately notify LAWCLERK if they are suspended from the practice of law or disbarred.
